Bino Training AS

1. General
This agreement (‘’Agreement’’) regulates the terms and conditions of the membership between the person (‘’Member’’) defined below, and Bino Training AS (‘’Company’’) in connection with purchase of video training or personal trainer services. Booking of this service below is referred to as (“Training’’).

2. Prerequisites for Membership

The following terms and conditions serve as prerequisites for entering into an Agreement with Bino Training AS:

2.1 The person has a generally good state of health and does not have serious health conditions and / or injuries that can put the person's life at risk.

2.2 The person is not pregnant.

2.3 The person is over 18 years of age. Persons who do not meet this requirement may enter an agreement through a legal guardian, who will be legally responsible for the membership and payments associated with the service.

2.4 The person confirms that he/she does not use any form of doping substances that are listed under Anti-Doping Norway's list.

3. Membership

The following terms and conditions apply to Members of Bino Training AS:

3.1 Membership in Bino Training AS starts upon the person's registration and acceptance of Terms & Conditions, with immediate effect.

3.2 The Membership is personal and may not be transferred to anyone other than the Member.

3.3 The Member may at any time upgrade or downgrade his/her Membership to gain access to more personal training sessions or other services or concepts associated with the Membership. Upgrades or downgrades will take effect from the following month.

3.4 Membership packages, concepts and additional services with associated descriptions and prices, appear on our website.

3.5 Members who hold a Membership that is no longer offered by Bino Training AS, will be notified and requested to change to a different Membership structure.

4. Payment

4.1 The Member shall pay a monthly membership fee or single-session fee and any other fees in accordance with Bino Training's at any time applicable prices. The same applies to a legal guardian who has assumed legal responsibility for the Membership under registration.

4.2 The Membership fee depends on which package the Member has chosen at any given time. The Membership package can be adjusted and will take effect from the following month.

4.3 The Member accepts that his/her payment card will be charged with the agreed Membership fee on the first day of each month of the Membership. The Member is responsible for having correct payment information at all times, such as ensuring that the payment card is valid.

4.4 If the Member does not pay by the due date, regardless of the payment method, a collection notice “inkassovarsel” will be sent out with a new due date. In the event of late payment, Bino Training AS will be able to claim the Member to cover costs related to late payments and interest in accordance with “inkassoloven” and “forsinkelsesrenteloven”.

4.5 If the Member has defaulted on a payment claim and receives a payment reminder, debt collection notice or debt collection claim from an external debt collector, the payment information on the invoice from the external debt collector will be used for payment.

4.6 If the Member shows up late to the booked time, the time will be calculated from the original start time. Cancellation must be made at least 24 hours in advance of the hour. Training that is canceled later than this, or that the member does not show up for, will be charged in full.

4.7 If the Member is unable to attend the training for medical reasons, the Member will receive the Training at a later date.

5. Health condition and personal injury

5.1 Training with Bino Training takes place at the Member's own responsibility and risk and Bino Training cannot be held responsible for any injuries or illness that the Member should incur during training. The Member must assess for himself/herself whether the general state of health is sufficient for training with Bwino to be carried out without risk of injury or illness.

5.2 The Member must provide Bino Training with all relevant information about his/her state of health, previous illness, or injuries that can affect the training. The Member must notify his/her trainer if there are exercises that cause pain during or after the session.

5.3 Bino Training may at any time refuse the Member to train via our services due to illness and injury.

6. Termination of membership

6.1 The Membership can be terminated at any time and can be done by contacting Bino Training at cecilie@bwino.no.

7. Privacy

7.1 The Member agrees that Bino Training can use electronic means of communication to communicate with the Member about matters of importance to the customer relationship, including newsletters and marketing of new offers and services. The Member has the right to access his/her training history and can demand that it’s deleted. Bwino will confirm receipt of the deletion notification.

7.2 Disclosure of information to third parties may not take place without the Member's written consent, unless the disclosure is required on the basis of law or part of payment collection, insurance claims or accounting.
Bino Training's rights

8.1 Bino Training can, without warning, adjust prices in line with developments in the CPI, but still limited to 3% per year. Other price changes require 30 days notice by e-mail and / or SMS.

8.2 Bino Training has the right to change the Membership terms. If the changes are of some significance to the Member, Bwino shall notify the Member before the changes take effect.

8.3 Bino Training is not responsible for obstacles or limitations that reduce Bwino's service to the Member, when the relationship is beyond Bwino's control and Bwino could not anticipate or overcome the consequences of the relationship (Force majeure).

8.4 If the trainer is delayed or unable to perform the agreed training due to illness, technical failures, termination of employment, or similar, the Member will get the Training delivered at a later date. Bino Training reserves the right to replace the personal trainer if necessary.

8.5 This Agreement will be governed by and construed in accordance with the laws of Norway. Disputes between the Member and Bino Training shall preferably be resolved amicably. If this does not succeed, each of the parties can bring the dispute before the ordinary courts. Any legal action or proceeding arising under this Agreement will be brought exclusively in the court located in Oslo.
